Terms of Service

Welcome to GoGo. These Terms of Service ("Terms") govern your access to and use of the GoGo mobile application, website, and related services (collectively, the "Platform"), provided by [GoGo Technologies Limited] (RC [RC Number]), located at [registered address] ("GoGo", "we", "us", or "our").

1. Acceptance of Terms

By creating an account, downloading our application, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

2. Account and KYC Requirements

To access the full features of the Platform, including the wallet and marketplace, you must register for an account and complete our Know Your Customer (KYC) onboarding process. This requires providing valid identification, which includes your Bank Verification Number (BVN) and/or National Identity Number (NIN). You agree to provide accurate, current, and complete information and maintain its accuracy.

3. Wallet and Payments Services

The GoGo Wallet allows users to send, receive, and hold funds.

  • Funding: You may fund your wallet via integrated third-party payment processors (e.g., Paystack) or via direct bank transfer.
  • Transfers: Peer-to-peer transfers within the GoGo ecosystem are subject to transaction limits based on your KYC tier as mandated by the Central Bank of Nigeria (CBN).
  • Liability: While we implement bank-grade security, you are responsible for maintaining the confidentiality of your PIN, OTPs, and login credentials. GoGo will not be liable for losses incurred due to unauthorized access resulting from your negligence.

4. Marketplace Responsibilities

GoGo operates as a platform facilitating transactions between independent buyers and sellers (including agricultural producers and vendors).

  • Platform Role: GoGo is not a merchant of record, a buyer, or a seller of the goods or services listed on the marketplace. We do not take title to the goods and are not responsible for the quality, safety, or legality of items advertised.
  • User Disputes: Any disputes regarding the purchase of goods or services are solely between the buyer and the seller. While GoGo provides tools (such as direct chat and voice calls) to facilitate communication, we do not guarantee the fulfillment of any transaction.
  • Logistics: Booking logistics through the Platform is provided by third-party delivery partners. GoGo disclaims liability for delayed, lost, or damaged goods during transit.

5. Prohibited Use

You agree not to use the Platform to:

  • Violate any applicable laws, including money laundering or terrorist financing regulations.
  • Sell illegal, counterfeit, or prohibited goods.
  • Commit fraud, impersonate any person, or provide false KYC information.
  • Interfere with or disrupt the security, integrity, or performance of the Platform.

6. Limitation of Liability

To the maximum extent permitted by applicable law, GoGo, its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use or inability to use the Platform.

7. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in Nigeria in accordance with the Arbitration and Mediation Act, 2023.

8. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes through the app or via SMS/email. Continued use of the Platform following such notice constitutes your acceptance of the revised Terms.
